Controlling corporate cowboys: extraterritorial applicaion of home countries' jurisdiction to EU corporations abroad: a window of opportunity?

One of the most daunting challenges of the twenty first century is the question of the control of multinational enterprises. This is so because while most states are parties to various conventions on human rights, very few global conventions restrain corporate behaviour. The debate currently seems to be in a flux as initiatives at international, domestic and private levels continue to fail to provide much-needed remedies. The most recent of the attempts at the international level was the ‘Norms on Responsibilities of Transnational Corporations and other Business Enterprises with regard to Human Rights’, (the norms) adopted by the United Nations Sub Commission on the Promotion and Protection of Human Rights in 2003. The norms were subsequently adopted by the full commission in 2004, which thereafter disseminated the document for comment from businesses, governments and NGOs.
