posted on 2023-06-07, 22:31 authored by Jorg MonarThe "space of freedom, security and justice" (AFSJ) as a guiding concept for internal and judicial policy of the European Union is unquestionably among the most important new integration objectives, which were introduced in the nineties in the contracts. Although it is the implementation of some of its objectives (such as on immigration policy) been a serious delay, the AFSJ includes around 100 per year by the Council adopted texts, monthly meetings of the Council's Home Affairs and Justice, and several newly formed structures ( Just like ¿) held good for a few years of the most dynamic policies of the European Union. This may also come as no surprise that treated under the general heading of AFSJ topics include the asylum and immigration policy on border controls, to the police and judicial aspects of internal security but also to the central (and often politically charged) domestic political challenges of the Member States, cross-border at least the dimensions of these challenges are increasingly looking for common answers. Against this background the AFSJ had in the work of the Convention to come inevitably considerable importance, which then also in the Bureau-defined list of questions for this area, 1 of the establishment of a special Arbeitsgruppe2, several major initiatives (such as the common Fischer / de Villepin have defeated proposals of November 2002) 3 and finally the introduction of many new or modified provisions in the draft constitution. In analyzing and assessing the relevant parts of the draft constitution is considered that the need to reform the Union's interior and justice policy is likely to be less pronounced, despite some shortcomings than in many other policies of the Union. In fact, the reforms of the Treaty of Amsterdam in this area, combined with the ambitious objectives of the European Council in Tampere in October of 1999, comprehensive nature, that their potential is to be considered at this stage at least the set goals of action as far from being exhausted.
